To study Judicial determinants of the ordered obstetrical and fertility interventions. Nature, corresponding laws, decisions upon the 37 expounded holdings at the Probate, Trial, District, Appellate, and Supreme Courts are studied in 92 published materials identified through the ACOG, RCOG, SOCG portals, and Legal Scholarship Repository. Hearings are held in the US (83.8 %), Canada (10.8 %) and U.K (5.4 %). Of all the hearings reviewed, 27 % concern mentally impaired, 37.8 %-maternal incompetence, and 21.6 % cases are of criminal (...) nature. The Judicial determinants vary from country to country. In Canada, the ordered medical interventions are effected by the child protection legislation, whereas in the US, by court orders. In majority of cases, orders are obtained by dismissing the patriae petitions for involuntary sterilizations of mentally impaired sui juris adults (57 %); coerced obstetrical interventions (33.3 %), fetal custody (50 %); enforcement of surrogacy contracts (62.5 %) in favor of the Common Humanity Benefit clause; and recognizing the rights to inherit in posthumously conceived children (80 %) pursuant to the Social Security Act, Law of obviousness, Law of inherent anticipation, and Intestacy statute. Current study prioritizes two questions: (1) whether it is justified to override the wishes of a competent patient purportedly in her best interests; and (2) whether the patient’s autonomy and competence is an absolute concept. With the law unsettled as to a woman’s right to assent a treatment and contradict her fetus, parties concerned with fetal rights should consider exercising of screening tools on maternal judgmental fitness jointly developed by medical and legal practitioners. Further, given the advances in gamete conservations, states consider enacting legislation in order to safeguard the orderly administration of estates disrupted by claims from posthumously conceived children. A balance must be struck between the child’s right to inherit, the state’s interest, as well as the interests of prior born children. (shrink)

Une approche philosophique de la prière à des fins politiques est possible dans le cas où les deux substantifs sont mis en relais inconditionnel. Le premier élément responsable de cette filature des liens c’est la présence de l’autre. Prier et faire de la politique sont deux activités humaines trop humaines qui exigent l’ouverture à l’autre, pour l’autre comme pour l’édification de sa propre identité individuelle et collective. Elle calme les esprits, la volonté, apaise l’angoisse et solidifie les liens sociaux. Edward P Thompson’s disapproval of Methodism (which was his own background) is well known, especially in The Making of the English Working Class. There he describes it as religious terrorism with a destructive moral machinery and all too reactionary. However, through a close reading of the sections on Methodism, this article reveals an ambivalence within Thompson’s own text. Again and again, he notes in passing that radicals emerged from the Methodist ranks, so much so that the Methodist Conference worked hard (...) to deal with the problem. Descartes is often presented as the "father" of modern subjectivity, because of his identification of thinking and being (cogito ergo sum).However, the autonomy of the cogito rests for its validation on the idea of the infinite. Consequently, what is the relation between the subject and that idea? This article tries to elucidate the complex role of an idea which, as Descartes himself seemed to admit, is very ambiguous, being "cognoscibilis et effabilis" and "ineffabilis et incomprehensibilis" at the same time. This (...) ambiguity, as is argued, determines the very nature of the "Cartesian subject" as such, and that Descartes describes as being "something intermediate between God and nothingness". In The Search after Truths Nicolas Malebranche (1638-1715) claims that the first man, Adam, had the same senses as we do, that he felt the same pleasures and pains as we do, but without being distracted from God. However, after he had sinned, his senses revolted against him and enslaved him, as they do us. In other words, because of the original sin the union that joins our mind to God and which raises us above all material things is weakened (...) by a union with our body, a union that debases us and which is the main cause of all our errors and miseries. According to the French thinker Alain (1868-1951), Descartes' Treatise on The Passions of the Soul (1649) contains three layers. First there is the pure physiological account of the passions: the body as mechanical unity ("automaton"). In a second layer Descartes develops a more psychological account: the passions described from the point of view of the union of the soul with the body. And in a third one, he points to the existence of pure intellectual passions (as the "intellectual joy"). What (...) is the relation between these three layers? Walter Biemel designated Time as the real protagonist of Proust's In Search of Time Lost. This article wants to analyse in detail the complex inner structure of that "Proustian time" by focusing on the existence of a double tension. Indeed, the awareness of time of the novel's protagonist "Marcel" seems to be determined by surprising "paradoxes". The first one betrays a strange opposition between, on the one hand, a very lucid description of temporality as a devastating power, but on the (...) other hand, a complete blindness to one's own ageing. The second tension consists in the fact that, although in one respect everything changed and all characters in the novel grew older, still at the end of his "search", and on the occasion of his long meditation about the meaning of the "souvenirs involontaires" and the works of art, Marcel affirms that he "remained the same". What is the meaning of this "sameness" in connection with time, and more precisely, in relating with the fact that everything vanishes, changes and dies? We state the consistency problem of extensional partial set theory and prove two complementary results toward a definitive solution. The proof of one of our results makes use of an extension of the topological construction that was originally applied in the paraconsistent case.
